stbx agrees to my moving OOS...

with our children before the divorce is final. He intends to send me certified mail a letter he has hand-written, signed by him & notarized allowing me absolute permission & will not now or any time in the future contest the move. I would be moving as soon as I rcv'd this letter & had it filed along with all of the proper divorce papers, agreements, etc.. If I have this notarized letter from stbx, the judge won't still try to keep me from leaving, will he/she? I need to be sure this would be a legal thing that would hold up in court and not something I should worry about if I were to move once it was filed.

Anything that's not a court order doesn't exist. If it's okay that you move, that letter can be used to demonstrate his approval of it TODAY but when it comes right down to it, he may rescind that approval.

You'll need to come up with a parenting plan that is fair, and you'll usually have to provide/pay for all transport of the children to see him.
