Hi, My son is a diabetic (Type 1) and as you can imagine, the Dr bills and medications are expensive, even with insurance. We spend 100 a month or more on insulin's, needles, test strips, bla bla bla. The Ex is supposed to pay her part but never ever does. This year she has run up a 600 dollar tab and I would like to be reimbursed. I cant see spending a grand on an attorney when I would net less than this.
Has anyone had experience with filing these sorts of suits on their own? I'm not really sure where to start.

If you've followed the CO in regards to giving her the bills and she hasn't paid then take her to small claims court. No attorney needed and since it's a small enough amount to be eligible for small claims you shouldn't have an issue.

What state are you in? SC? Did you contact your child support enforcement agency? Texas will collect unreimbursed medical for parents too.

Stay out of Small Claims Court , you'd get a judgement that isn't the easiest to enforce and subject to discharge in bankruptcy. SC CS Enforcement cannot help as they won't enforce a claim for unpaid medical expense . The best way is to hire an attorney and request she pay your legal fees which also has risks ( she wouldn't pay anyway ) . You could always try yourself and hope . The forms you need are available here :
w ww.judicial.state.sc.us/forms/searchType.cfm
Use SCCA457 .
-------------------- Careful. We don't want to learn from this.

I live in Texas, and in my state, once you have $500 worth of documented doctor bills and proof that you have given the Ex notice of each bill wiwthin the prescribed 30 days after they have been incurred, the State of Texas will go after the ex for those medical bills. Maybe it's the same in your state.
