I have two children that live 50% of the time with me. I claim on on taxes and their Mom claims the other. I have recently been given the option to have an HSA at work and my work will make contributions to my HSA based on the difference in the premiums from the PPO and the HSA. The problem is that the kids are on my insurance, and unless I claim both kids, I am told that I cannot have a HSA. I have heard conflicting opinions on this. It has to do with the eligibility guidelines that state that if you are claimed as a dependent you cannot open an HSA, however it would be my HSA and the kids would be covere under it. By the way they are 6 and 8 not 18+ which I think this eligibility guideling about. Any help on this is much appreciated.
