living with a roommate
      #710012 - 11/28/10 10:34 PM

about a month ago i left my husband of almost 5 years. we have a 3 yr old daughter. my daughter and i are currently living in my parents 1 bedroom private house on their property. i have not yet filed for divorce because im waiting till he gets his 2010 tax return. i am considering moving into a 2 bedroom home with my best friend. when he caught wind of my plan he started threatning to take me to court. what are the rules for living with a roommate of the same sex?

Lol. I'm pretty sure there aren't any...and even if it were a friend of the opposite sex, there would have to be a morality clause that prevented you from living with a guy. Is the best friend an ex con, or sex offender?

Is she just a friend and not a lover ?

Some states have rules that the child must have their own room (or so I have heard here)

You shouldn't have any issues. Do you have an attorney? What state are you in?

The only issue I can see is the fact that the house only has 2 bedrooms. Some states say that children can't share a room with an adult. Others simply say that opposite sex children can't share a room after a certain age. Is it possible to look for a 3 bedroom home? If so it's doubtful he would have any leg to stand on.

You would have a problem if the roommate is of the opposite sex because he could use adultery in his charges for divorce. This would limit the amount of settlement you would get, and put you in a precarious situation. Look up the laws governing adultery under your state laws.
