Well, I have a question. I am in the last stages of a long seperation and it's finally come down to the paperwork. Here's the skinny:
We were together for five years before he proposed. I had the ring for four months before we were married. Three months after the rushed and regrettable ceremony, we seperated. I still saw him daily but we lived seperate places. It's been like that the past two years.
Two weeks ago I told him that our relationship was going nowhere and that I was ready to go through with the actual divorce. He claims he's talked to an attorney and the att'y told him that since we were legally married for less than six months the ring is his, not mine.
Now, that would be all well and good if we hadn't been common law husband and wife for about a year and a half BEFORE I even got the ring. Also, even though we haven't been living together we have been married for two years and three months.
Also, his father was the one who actually purchased the ring. (Which hasn't come to light until recently.) Does HE get the ring back, or does his Dad? Does the fact that his Dad bought the ring (and I'm talking about swiped his card at the jewelry store for it) change the nature of the gift at all?
I'm not spiteful, if the ring is legally his well, it's his. But, I could sure use that money to start my new life and considering that my soon-to-be ex destroyed my credit and cost me my job with his repeated phone calls... I think I may well be entitled to it.

My divorce took place in VA, and I was told by my attorney the ring was mine to sell. It may be different in your state. I find it hard to believe that the length of marriage comes into play with the engagement ring.
I hope you can use it to get by. It certainly helped me, even though I did not want to sell it.

It is my understanding that the ring is considered a gift, it is yours.
