Hi. My husband is in the military and living in SD, were we were married. I moved to Florida to further my education. During this time, I found out I was pregnant. He has decided to divorce me, I am 8 weeks pregnant. I had a miscarriage in November and I will be the first to admit I didnt handle it well, I was very down, I felt like I lost a part of me. Since being home I have atteneded doctors appointments, gone to DCF for food stamps and medicaid, looked for part time jobs, and have recently been accepted to dental assisting school. He is threatening to take custody of the baby once it is born saying I am mentally incapable of having a child and unstable. I dont see how, I live in a wonderful home with my very supportive family, I pay my bills and have a car. I do not use drugs or drink alcohol. Do you think he has a case and will essentially take the baby from me?

Id also like to add that I am in Florida, he is in South Dakota,in April he is deploying to OSAN AFB in Korea for a year and a half. After that his followon is unknown to me.

He has been diagnosed with Depression in the past, and has had a run in with legal for sleeping with a minor, whether that case has been dismissed or is ongoing, I have no idea.

You will probably need to get a consult with a lawyer regarding his threats that he will take custody of the baby. From what you have posted it seems unlikely. If he is in the military and deployed, then his ability to take care of a baby would be difficult.
Good for you on getting your life on track and your acceptance into dental assistant school. If you have a stable environment then I would think you chances of having custody are more swayed in your favor.

Most states do not allow pregnant women to divorce until after the baby is born.
He is PCSing to Osan not deploying. He will get his follow on about 8 months into his short tour.
So are you prego or did you miscarry?

Why are you on medicaid? You should be covered by Tricare?

Im not on medicaid, but am working towards getting it since we are getting divorced...I wont be on tricare once its official.
I miscarried in November and became pregnant again in December so I am pregnant right now.
Im pretty sure Florida allows you to divorce when Pregnant, but then again, I'm not a lawyer. Which by the way, my Mother and I are looking for one as we speak, $$$ :(

Check on this but usually you are covered by Tricare during the duration of your pregnancy and up to a year after the divorce.
