Bottom line, the child does not live with you, and assuming you do not support the child living with your parents, then No, you cannot collect child support for a child you are not supporting.

My parents have partial custody of my son and take care of him 90%. of the time.

I believe the person eligible for support is the person taking care of the child 90% of the time. Not any other person or parent.

You cannot collect child support unless/until the child lives with you (or you are custodial/primary residential parent).

If that is your goal, then you should file for custody. Part of that custody will probably entitle you to child support from the child's other parent.

Are you mom, dad or a troll? Your post from last spring.

Long story short:

I have a great 10 year old son.
The mother and i were never married.
She did decide to leave me during his first year.

I have paid child support on my own over the years.
And keep him when I can. And keep records of payments

She and the son live in SC
Im in NC.

I was wondering if all my years of payments would be considered "gifts" by the court if she decided to get tradition child support with the courts.

Would I have to repay years of back child support? That would be financial nightmare.
