Age for a child to choose where to live

at what age can a child choose which parent they want to live with in the state of Tn. The child lives with her mom in Tn, but wants to live with her dad in Ky. she will be 13 in June.

There is no certain age. When the judge feels the child is mature enough, He will allow the child to decide.

So I have 2 younger brothers, a 10 year old and a 13 year old. My Dad is divorcing my Mom and he repeatedly threatens to take them and leave and not tell her where in TN they are.

He said it's legal because it's their choice, but she things this will be kidnapping.

Who is right?

Checked the law, this only applies to if there is an injunction for custody.

The judge will take the child's decision into consideration when they turn 12. When they are under 18, you have to give the other parent a document that states he intends to move and where if he takes the kids. It sounds like it would be kidnapping to me. He can't just get up and go.
