My wife and I misrepresented when we came to Canada and got refugee status.Now i found out my staying in Canada was because of her and nothing about me and the kids.I came clean to the officials and ask to leave the country to our original home.However my wife do not want to return and trying to fight the case of misrepresentation.The mess is that,we have 2canadian born and 2 outside canada born kids.The immigration summoned us to vacation hearing where i asked my status to be vacated and want to return,i wrote a letter of apology to Canada and the Canadian People.
My wife asked her date be adjourned which they did but i proceeded with mine and got it done and set to leave.
I have my 2 outside born who do not have any status in Canada with me whiles my wife has the 2 born here with her outside the family home.
My wife has filed for custody of all kids (including those without status)which may take long time to finish it.
My 2 non status kids want to depart with me.
We will have our second court appearance where my wife has asked for a non removal order of the kids(Non status ones)from Canada to our original home.But the funny part is that,my non status kids and myself are under removal order by the immigration and my wife will also be once her hearing comes forth.Is the Judge going to buy her non removal order nonsense and ask us to stay till custody issues are settled whiles we(Me and the kids) dont have status here at all?
I dont want to loose my kids to childrens aid and want to take them with me back home.As far as i know,she will also be under a removal order when her case is called because we both committed the same crime.
I have asked that all 4 kids depart with me/us and if wife wants she can stay here and fight to remain which ultimately will not be possible due to our initial credibility.
Can the Judge here in Canada issue a non removal order to my wife on behalf of my non status kids whereby we are all under removal order?
