As I stated, it doesn't matter what you disagree with. What matters is what FAMILY COURT JUDGE agrees or disagrees with.
But I do know that I will take what a family court attorney who has said is very likely to happen over an internet stranger.
Just like the original poster here would be better off discussing this issue with a family court attorney in her area about what is likely to happen.

I do have an appointment with an attorney to answer this question and some other issues. I want to clarify too that I don't get aid, he is the one who gets welfare. I only get SSDI,which is based on my earnings through my years of employment, not a goverment hand out. Back to the original topic.My mom has been through a divorce here in California and she insists that since his income is was considere community property, even if he didnt file using my income, that some of that refund, is mine too. My guess is that he may have got around 6k. Ridiculous isn't it?
