married 33 years; divorcing basically to save our house, see no other way to get the necessary money....how long will I have to wait to receive my share of my husband's pension???? and since I would be using the pension to save the house what tax penalities will I have to pay

I was married for 30 years and did not have a very good divorce lawyer at the time of my divorce in 1996. I never remaried. My divorce did not give me the right to any of his pension. He died 1 1/2 years ago and was still working at the time. He had been married to his second wife for 3 1/2 years at the time of his death. His wife makes more money than he did and has always worked so she should be financially secure. Is it possible to do a modification of the divorce at this point? I doubt it but it certainly is worth the question.
