Hello Everyone, I hope you are all doing well. The case goes as such: The couple resided in Illinois and bought property (Condo). Last May, they left Chicago to return to Los Angeles (where the husband is a resident). They decided on an amicable divorce in October, and the husband filed for a divorce. The wife was served, but did not finish the Financial Disclosure forms, hence the case has not been brought before a judge. As it stands, no court date has been assigned (and none is expected). The wife has since returned to Chicago, where she currently rents the property without any support from the husband. The husband is now totally unresponsive to the wife's attempts to contact him. California law states that the petition for divorce will be dismissed after 6 years if nothing else happens. The wife is now wondering if she could file for a divorce with fault due to abandonment, seeing as the husband has cut off all communication. Seeing as there is currently a file (made by the husband) for divorce in California, would it be possible to file for abandonment in Illinois regardless of the fact? Would a lawyer be needed to do this? Thank you!
