Is cohabitation prohibited in Ohio after divorce?
      #750648 - 06/08/11 11:10 PM

My wife and I need a post nuptial agreement in order to stay happily married. Can't get one in Ohio and the only recourse is a divorce. Planning on getting a dissolution then getting a prenuptial and then remarried. So just putting in the separation agreement that we will be cohabitating. Anybody know of any VERIFIABLE issues with this? I don't see anything in the ORC about having to live separate if using incomparability for a no fault divorce. Yes this is being done simply to get around the ban. Supposedly postnuptial agreements encourage divorce. In my case the ban against them has encouraged mine. Anybody cohabitate after divorce in Ohio and the court knows this?

If I was your wife and you asked for a post nuptial agreement, we definitely would be divorced - and I would not remarry you.

The courts really don't care about cohabitation.

No one is going to have an answer to this because, honestly? Who gets divorced so they can get remarried and worries about what the court thinks about cohabitating in between? That situation is too convoluted to be mainstream.

"My wife and I need a post nuptial agreement in order to stay happily married. " Friendly, unsolicited advice - If a marriage certificate and vows aren't going to keep you together, another piece of paper with legalese isn't going to do it either.

Actually, now that I think back, that was something my ex tried to sell me on during our separation. We'd live together during separation and divorce, date and get remarried all over again. Of course, I found out later his girlfriend objected to that idea. Go figure....
