401k Division - Participation in gains and losses

Hello, all.

My ex-wife, a partner in one of the biggest law firms in the country, was required by California family court order to divide her 401k over two years ago, but has dragged her feet until now. I cannot afford a lawyer. The QDRO draft contains language indicating that my assigned share will include gains and losses; I would like to know the amount of those gains an losses before I agree, but her plan administrator is claiming that is unable to provide that information. Do I have the right to choose whether to participate, and can I compel her to tell me the difference? Thanks in advance.

Why do you care about the amount? You would receive any gains or losses on the divisible amount determined by the court decree or since the valuation date. That would not change.
