Hi - I've been divorced for about 4 years, father of 2 (10 & 8) and have joint and custodial custody. My oldest son has just finished elementary school and will start middle school in the fall. My ex and I cannot agree on where he should go. My ex and I leave in neighboring towns and currently they go to school in the school district she lives in. They no longer want to go to school in her school district and want to come to my town's school district. The school district I live in is superior to the one they go to now in reputation, state exam schools. The school he would go to in my town also ranks in the top 1/4 in the state while the middle school in my ex's town ranks the bottom half in the state. They also participate in several town sports in my town and have a wealth of friends.
I am told that because we are both custodial parents, we have to agree to the children's welfare. Both the kids and I want them for them to go to school in the better school district but she won't allow it. What can I to allow them to go to school in my town school district?

You have to go to court, present your case and let a judge decide if the 2 of you can't .
