Now she's asking for child support modification

my ex is really trying to stick it to me. Not only is she trying to relocate with our daughter i just received more papers in the mail asking for my monthly income. How dare she? I pay $119 a month, and she gets $58 of that. Why is she doing this to me? I called her and asked her why. And she stated that even with minimum wage i should be paying $67 a week. I have a wife and two kids to support why is she doing this to me? All i want is a relationship with my daughter. I think she's being very ignorant and unfair.

Having read your posts on the other forum (most of us read more than one forum, you know), You have it backwards.

Your ex isn't trying to stick it to you. You are sticking it to her.

Don't be surprised if the amount goes up and an amount tacked onto the higher weekly amount until the arrears are paid off.

Hopefully, she will also get an order to have your wages garnished.

I feel sorry for all of your kids. They really got the short straw when it comes to a father.

honestly i dont have any arrears im completely up to date. They took my income taxes in 2010 so im up to date.

Good for your ex. But she shouldn't have had to wait for your income tax refund. BTW, if you are continuing to pay less than the court ordered amount since the seizure, there ARE arrears.

BTW, you will more than likely (and most definitely SHOULD) be ordered to pay more than the pittance you are now.

Now, the question is: Are you going to continue to stick it to your ex and not pay your full share of support for your child?

i only have a court order to pay the $119 which is what im paying.

Medical costs are in addition to child support.

What was the prior order based on? Are you in a state that takes into account both parent's income? Was your last CS obligation based on you being at "poverty level"? In NYS if you are considered "poverty level" then the CS you pay will be decreased.

Same state may take into account subsequent children (children that came after the one with the current order).

Do you pay CS to any other children through a court order?

The laws of CS work according to your state- if your X is due an increase based on your income increasing then she is not being unfair. If your X is able to relocate your child- there may be a deduction in CS due to "extraordinary visitation expenses". However I would make CERTAIN that of your X relocates your child that she pays for 100% of the visitation costs.

the order was made in Feb 2009. No i dont make $2 a day. Yes they take into consideration my exs income. No i only have 2 kids (1 with ex, 1 with wife).

I think I would walk on air if we had to pay $119 a month in child support. If you are required to pay more it will come out in the paperwork. If the paperwork says you should pay more, then she is not sticking it to you, the court system is sticking it to you.

I would be curious to know the state CS was issued in and each of your incomes. Is or was your X on any state aid?

does it really matter where im from? Im not an ass i am a very concerned father. I love all my kids and i provide for them all as best i can. How come everyone in my life understands where im coming from except outsiders and people on my exs side?

Dude, I am about the MOST pro father guy on this site, and you are a jackass. You are paying virtually NOTHING in child support, and are complaining that she wants a LITTLE more. You are afraid to hire a lwyer cause your WIFE would get mad. Lemme tell you, I dated ONE woman who had a problem with what I did in regards to my CHILDREN. She told me to CHOOSE between her and the kids (I was an NCP at the time). She was left standing on my porch after I slammed the door in her face. Any decision that comes down to ONE adult, or ONE child is not brain surgery. The child is defenseless.

It doesn't, but that doesn't mean it wasn't court ordered at the appropriate amount. It also doesn't mean that his X is providing about the same amount HE is and that she is getting state aid because they are considered 'poverty' level.

We don't know enough information to surely say that he is doing LESS (financially) than he is able to.

I do think, from postings, that the OP seems uneducated and again I am wondering what their incomes are and their AGES. I am thinking young.

NM- Read some on the Custody board, apparently I was right I am sure the CP in this case isn't doing the child any good either. They are both a bit out there and it seems like they are trolls.

As the other posters have said I feel bad for your child. My husband paid $1000 per month in CS for two children, he was NEVER mad that he had to pay that amount. On top of the court ordered child support he had to maintain medical/dental insurance, and pay for 1/2 of all uncovered medical expenses. He also paid out a lot in extracirricular activities such as cheerleading, school photos, school fieldtrips. Also dresses for dances, make-up and hair for dances and you know what he was glad to do it. They are his kids and responsible for helping raise them both emotionally and finacially until they are adults. Grow up and take care of your responsibility to your child.
