Uncontested NY Divorce?
      #763763 - 09/28/11 03:59 PM

My former wife and I have lived apart and co-parented our two kids, sharing custody equally. We are seeking a divorce Together we own the home that she lives in and the kids do half the time. she can't afford to buy me out. the other parts of our finances we feel we can work out. what to do about the house? I don't want to ask her to sell and move. The house works for the family. I rent and I am fine with that for now.

With respect to an uncontested divorce, this is where the parties agree on all the issues, agree to be divorced and ultimately sign a Stipulation of Settlement. This Stipulation of Settlement is then submitted to the court along with other documents and in approximately two or three months thereafter, the parties are divorced.

When you think of an uncontested divorce or the Stipulation, think of it as a contract between the parties as to each and every issue that pertains to them. I am talking about equitable distribution, child support, custody, retirement benefits, medical insurance, everything. In order to get an uncontested divorce, the parties have to agree to each and every issue. If there is an issue the parties do not agree on and a compromise cannot be reached, the parties cannot settle their case and will have to proceed with maters in court.

My best advice is get together and try to reach an agreement with your ex-wife. If the mater cannot be settled then you may have to seek out the help of a divorce attorney and handle the matter in court. Please call Phillip J. Jusino & Associates with any questions or concerns.
