Response to OSC

My court date is October 17,2011 for my OSC that I brought against my ex to terminate spousal support based on cohabitation and her failure to abide by the Gavron warning. She filed a response but only checked that she did not consent, and gave no declaration or challenge to the two issues I raised in the OSC. Will she ba able to contend anything in court without raising a defense in her response?????

Ok because she did not give a response or anything that she would consent to. In all the prepared OSC and responses I've seen if you check that you dont consent then you give a declaration or an alternative. Does this sound right???

My ex never responded to my motion to terminate alimony in CO. The judge granted the motion 2 weeks later without a hearing. Although she repeatedly denied her remarriage when I asked about her name change and wedding photos on facebook, she wasn't prepared to defend herself in court.

See, if I was a judge, in a case like that, where she LIED about getting remarried, I would have charged her with, at MINIMUM, perjury, more likely attempted FRAUD.
