Ive paid my child support on time ever sense Ive had it. Ive been late a week maybe twice. Work has slowed and my wife has been laid off. I've not been working my full 40 for over a month now, and there are rumors of lay offs.
Im late a week may end up beeing late 2 weeks. She is threatening me with calling child support services. If I cant pay it I just cant, but can they put me in jail or anything? By the way Im in Georgia.

If she contacts cs services, they should give you notice and an opportunity to explain why you are late. An element of contempt is "willfullness", which means you can pay but refuse to. You can also file for a modification of child support pro se. Paperwork is available on line and a few counties have pro se litigant seminars.

I would assume is takes more than 1-2 weeks to be put in jail.

Thanks. I'm not bad off enough yet to file a mod. And if what I heard on the phone this morning is true my job is safe. Just gotta get past this slow months. We are supposed to pick back up. Hope they are not blowing smoke. If ya know what I mean. Thanks for your response. :)

I would hope so. I keep hearing all these horror stories of some dads who do actually pay and are late because of loss of job getting put into jail. You have to admit all though some of our laws are in place for a good reason. Sometimes they are enforced with the wrong people to severely and with the right people not so severely. I hope that last statement made sense. Maybe I'll retype that later. Not always good at writing down what I'm wanting to say. lol

You aren't going to be technically "late" until the following month. No one is going to care about CS being late a week or two...if you go on a month and then continue to be late, that will be a problem. Since you still have a job your X can ask that CSE get involved and garnish your wages. That way your CS comes straight out of your check and you never see it. That guarantees she will get paid and you will not have the option to withhold the CS. The CS then goes from your check to the CSEU (Child Support Enforcement Unit) and they send it out to your X in a check, or more than likely it can be deposited into her checking or through a Debit card issued by them.
Obviously, you can file a modification in support if you feel as though you need to at any point.

No modification's. Im just going to be late a week possibly two. Money is tight no doubt. Christmas didnt help, but I should be able to keep up with it. So long as I keep my job. And if my wife finds a job soon deffo wont be a problem. Just read her email before I posted this yestderday. I wasnt expecting that. Last time I was late was a few years ago when the company I worked for went under.
