[censored]://[censored].foxnews.com/politics/2012/01/06/federal-government-expands-rape-definition-to-include-men/
Expanding the definition of "rape" to include men will give a true representation of the numbers of victims, and thus allow a better allocation of resources.
One down side to the re-definition is that they will include "victims" who were supposedly unable to consent due to drug or alcohol use. Now, NON CONSENTUAL drug use I agree with, but if a person gets drunk and has sex, and later on regrets it, that is NOT rape, thats a bad Friday night.

I believe the reference to drug and alcohol use relates to sex with a person who is passed out and incapacitated to the degree that they cannot consent. I have had cases charged with such facts. For example, a number of people attend a house party. Many pass out around the house on couches and floors. One party goer has sex with an incapacitated female who is passed out.

I just wish there was a way to ALLOW that kind of charge (which I agree with completely), but weed out the, "Well, I was drunk, so even though I SAID yes, I was really drunk, and didn't MEAN to say yes."
FTR, I agree that having sex with a passed out individual is wrong. However, should I end up passed out, any woman is free with have PROTECTED sex with me, as long as you take pictures with my phone so I can see them later.

I have never seen a case charged in that context and think it would be highly unlikely to be charged and less likely to be winnable at trial.

Sorry, I find it hard to believe you have never seen such a case, as such cases LED to some universities requiring students to sign PAPERWORK agreeing to have sex.

---> I guess it depends on how 'drunk' they are. Maybe parents should educated their children it doesn't count as 'consent' if the person can't stand up and/or walk 50 feet without falling down.

The problem is WHO makes the "too drunk" call? And if a woman can't consent because she is too drunk, does the male get a pass as well for being to drunk to KNOW she didn't consent?

---> That's a problem isn't it? And I agree that the 'alcohol impairment' door should swing both ways, but how exactly is it going to work in a way that is fair and equitable?
