College costs when no language in agreement
      #778945 - 03/04/12 09:36 AM

I am having a heart attack this morning! I know during the course of my divorce, there was language addressing how college costs would be handled. Today, I broke out my signed agreement and I have no idea how in the world all language regarding college was removed. Am I now stuck paying 100% of the college costs for my kids because it was never addressed? My son already is taking college courses in high school and my ex is refusing to pay any of it. I'm guessing I have to go to court now to address this, but I'm terrified about how the courts handle this when there is no language at all. Previous agreements stated that each parent would contribute the pro-rata share of a state college. Please, if anyone has gone through this, let me know what happened. Thank you.

Depending on what state you are in, college may be post-majority support and therefore not addressable by the court if its not in the agreeement. What State? Age of the kids?

Check your state and see if its 50/50 cost for kids college... if your in one of those states id take the x back to court and get the decree modified.... im in a similar situation but required to pay 50/50 but x is pushing a private college with astronomical tuition and even half of the tuition is half the value of my home....

Married parents aren't required to pay for tuition so it's not unusual in most states for divorced parents to not have to pay. Usually taking college classes in high school is part of a high school program and doesn't cost much if anything. Once the student graduates, they need to complete the FAFSA to see if they qualify for financial aid.
