What age?

At what age are kids taken seriously in court if they want to change which parent they live with in Illinois?

A change of Custody is never simple. In Illinois decisions are made based on the Best interests of the child under Illinois Statutes 750 ILCS 5. The factors include the wishes of the child. However, that is one factor among many.

In most states, children do not have a significant say until they are in their late teens. They may express a preference in many instances in the early teens - 12 years old or so. Each county and each Judge may vary in their views as to age. In most cases, you should have a compelling reason for the change besides the child's desires.

In NJ the judge will take the child's wishes into consideration at age 13.
