Hi, new here. I've been legally separated since Feb, 2010. My x-wife and I own the home she is living in. She does not work. She and my two kids have lived in our house and I have paid all expenses to keep them living there since the separation date. This includes mortgage, tax, utilities, insurance,food, etc... We have an agreed-upon separation date that is on all of our court papers, but we never had a financial agreement written up until recently. Looking at IRS publication 504, i THINK I'm entitled to claim much of that as alimony, but I'm not certain. Would anyone here have some good information they can share???

No, support payments are only deductible if they are required by, and explicitly defined as support, in a written agreement approved by the court in the tax year being claimed, or subsequent years.
