QDRO and vesting question
      #780744 - 03/22/12 09:20 AM

I am in NJ. I was married for 11 1/2 years. I was divorced 3 years ago. My ex never answered the charges or showed up in court, so I got a default judgement. There was no QDRO. I have a pension and a 401k. At the time the divorce was finalized, I was not vested in my pension, but I was vested in the 401k. Is my ex entitled to my pension and/or 401k and can my ex file a QDRO years later after we both remarried?

The default judgment presumably gave you everything you asked for in your complaint/petition. By not showing up she forefeited any right to challenge any issue, including division of property. No QDRO is possible at this stage.

I had a horrible lawyer. My complaint/petition only asked for divorce. No other issues were addressed.

I had a horrible lawyer. My complaint/petition only asked for divorce. No other issues were addressed in court. I kept my debt/bank account. She kept her's. All the property (what little there was) has already been split up.
