Modification

When our divorce was filed, I got one of the vehicles. The court ordered that he would make the loan payment for the vehicle until the loan was paid off in April 2012. Because of that the child support was reduced until May 2012. A little over a year ago, he got a new loan on the vehicle that lowered payments over $200 a month, but extended the length of the loan payment. He is now trying to modify child support because the vehicle isn't paid off. He also has a new job where he makes a lot more money. I have never pursued modifying the child support for either situation. We were able to keep the divorce out of court or drag it out and I want to keep it that way. I've been told that if he pursues it, it will go to court. Should I bother fighting it? Or does he have a solid case.

If you have the paperwork showing when the loan would have ended you may have a case. Also check the wording....does it say "when the vehicle is paid off" or "when the vehicle is paid off in April 2012". A defined date could make a huge difference. Otherwise he may have found a loophole.

It doesn't actually say anything about paying the vehicle off. It only states that as of May 2012, the amount increases to what it should be.
