Spousal Support increases based on remarriage?

Hi I have been divorced for 5 years and will be getting remarried this summary. I was married for 17 years in California and am wondering if my ex-wife will be able to request more spousal support if my new wife and I create joint accounts?

The reason I ask is that my ex-wife has taken me to court every year since the divorce, wanting more money and she has been granted it.

Massachusetts was the only state I know of that considered the new wife's income. And they passed a new law to stop that recently.

Alimony should be based on income, not your bank account statement anyway.

What I don't get is why you want to pay alimony to another woman. At least get a prenup, or you will fall into the exact same quicksand.

Two things:
- 1st: A new spouses income isn't considered when looking at alimony increases.
- 2nd: Get a better attorney. There's no way in Hades she would've gotten increases FIVE yrs in a row if you had a lawyer that could fight their way out of a paper bag.

I totally agree with the other poster...getting married again???? Get a pre-nup to protect yourself from this happening again...kind of like been there done that....

and find out what the laws are in your state...if I was marrying you and found out that MY income had to go to your X ....I would NOT get married to you...

but then of course does your new bride work? or in a similar situation like your former spouse...where you would have to pay her spousal support ...

protect your assets
love may be blind
but when it comes to money
greed sets in

get a prenup
and "if" in your state, your new spouse's income does count towards paying spousal support i would seriously consider not getting married

that would just push me over the top
having to pay someone part of my income just because i married her X...that makes no sense at all

if and when you get married you may also have to know the rules on co mingling funds withyour new spouse
will your joint accounts assuming you do that count towards total income so your x can keep taking you back

if so...keep all monies separate
but then you need to get some really good legal advice

why does your X get alimony anyway
does she work?
child support is one thing but alimony?

whats the deal there?

Thanks for the replies - just for more info on my ex:

- My ex quit working during our marriage and did not have a college degree
- Every year, after the divorce she knew I would get a raise, so she takes me to court sometime in Feb / Mar and the judge granted her more money, based on her lack of earnings and her attending school
- I hired 2 attorney and they both stated that my ex can continue to take me to court every year, subpoena my employer for my salary records and request more money
- At the last hearing I asked the judge why my success was being hindered by her inability to get a job. Her reply was "that is the way our California system works"
- My last attorney told me not to buy any flashy cars, wear expensive clothes or talk to my kids at all about money as my ex can continue to suck me dry, claiming that her current lifestyle is not up to the standards it use to be

What a wonderful state / country.

Sorry....that stinks.

I can *kind of) understand ss based on your income during the marriage, but basing it on raises that came after the marriage is ridiculous ! For child support, yes, but for ss.....that's pathetic !

Just hire some guy to marry her. I went to bodybuilding.com and offered $10,000 for someone to marry my ex. There is a whole forum full of unemployed guys on steroids. Some of the guys were interested, but in the end some sucker did it for free.

your sympathy for the OP sounds kinda hollow...Try again...and BTW, YOU YOURSELF said you wouldn't date anyone who wanted a prenup. Most women won't, because most women are on the take for the cash. Period.
