Left my husband in January, both living apart since then and both have filed for divorce. I want to buy a new car.....will that be considered common property as part of our divorce? will he be able to claim half ownership since we arent divorced yet?

I think so, but remember......
If you would be paying cash for it, he would have been entitled to his portion of that.
If you are financing it, he can't ask for 1/2 of the car without asking for 1/2 of the loan too.
