My soon-to-be ex says that a separation in Virginia is only legal if there is a signed agreement. I cannot find anything that verifies this. We have been separated for 17 years and she is going after my retirement and wants 1/2 of it up to the date of divorce. I feel it should be 1/2 of my retirement up until the date of separation. No paperwork, just witnesses. Can someone direct me to a website that addresses this issue so I don't have to hire a lawyer?
Thanks in advance.
