retirement fund?
      #787060 - 06/20/12 08:28 AM

I lost my job after 23 years and I am going back for a modification of alimony. My retirement fund is one of the only things I got other than personal and pre-marital items. I was forced to bankruptcy and this fund was spared. Is my ex going to be able to take this since I can not afford to pay her alimony at this point in time? it's under $30k but it's mine! (or is it?)

As long as your alimony is not defined as "non-modifiable" I think the odds are in your favor of getting a reduction. Alimony is primarily based on incomes not assets.

I think that if that were me I would be tempted to take the money out of thebank, and put it in a safe deposit box, telling her it was spent. That way she cant get her grubby hands on it

Sadie, if you are female I want you to know you have improved my assessment of your gender from utterly dismal to maybe there is hope after all.

I'm so sick of all these "feed the leech" commenters.

Yes, I am very much female. I have always believed in earning my own way, and have been very successful. I dont believe in alimony, never have, never will. People should be partners, both earning their own way.
