My husband and I have been separated for a couple of years and I am at a point where I am ready to move on with my life. I have been waiting for him to hire the attorney and us sign papers but he hasnt done it and doesn't seem to be in an hurry. So I am ready to hire the attorney and file myself. I have spoken to my attorney and their were a couple of questions we need answered. I know that after being married for 10 yrs I will be able to draw off of his retirement. My qustion is can those years be combined. We were married for 4 years and then divorced and after a brief seperation we remarried, we will have been married this time for 10 years in August of next year. Do I need to wait til next year to file or do the years from our previous marriage count? And if I should ever remarry does that prevent me from receinving my part of his retirement?
