Without getting into all the ugly details, I am disputing the remaining balance owed to my horrible matrimonial attorney that represented me last year. I received the 'threatening' letter from her a week ago indicating that I must pay or I have the right to fee arbitration if I file with the Fee Secretary within 30 days. I've placed a few calls to the fee secretary with no response. What are my legal rights here --- especially if I can't even get a call back from the fee secretary? Do I have any rights here whatsoever to dispute the monies due to my attorney -- and yes, I have some very valid reasons, at least in my opinion, to dispute this amount.
Finally - what is a fee secretary and is there only one of them? I don't like the sound of this - my attorney sends me the collection letter and tells me my only right is to go to this ONE fee secretary. I'm sure that she has a relationship with this fee secretary to begin with. I'm sure they know each other well....doesn't sound too fair to me.
Any advice would be appreciated.
Thank you

You do have the right to contest her fee, and its crucial that you have the paperwork to back up your counterclaim. Contact the NJ state bar association for the forms. I believe that first you must write a letter to your attorney with your complaint, and the proof to back it up. If she still contests it, you can pursue the matter with the bar. I know this because I had a terrible divorce lawyer 3 years ago; I finally fired him, and he sent me an outrageous bill for time spent on my case. Thanks to letters from my husband's lawyer complaining that my lawyer was impossible to get in touch with, I was able to back up my complaints. He and I ultimately settled on a final price. Its a pain in the neck, and a little intimidating, but its doable. Best of luck.

Sounds like you and I had the same attorney! She demanded to be paid in full,....would not let me make monthly payments, wanted me to put it on my credit card! I had already fully paid her a huge amount of money and had $17,000 on credit cards from her service! So, when I got the letter demanding to be paid in full with the arbitration number on the bottom of the letter, I thought, why not!
We went to arbitration and they took $5,000 off of my bill! It was like David and Goliath! Me, being David! So, go for it, you don't have much to lose!
