Cohabitation
      #789043 - 07/30/12 05:29 PM

The State is South Carolina,

Here's the thing,

A husband hit his wife and daughter and left the home and filed for divorce, they went to court and had alimony and support etc set up, he was to pay all bills etc but he let the house forclose on them, the woman had a friend from another country visit on a Travel Visa for 90 days and stayed with them, when they got a notice to leave the house, the husband would not help, he wouldnt give their money earlier to help them find a new place, he left them high and dry, the friend stayed for less than 3 months and left back to his own country where he was born and lives,he helped them move and get into another place, and nobody had a problem not even the husband, now it's been 5 months later and the friend has gone home and the husband is filing for cohabitation because he wants his money back because he has a new woman and lives with his mother with no bills or anything of the sort, what can be done so she doesn't lose the only income she has left?

Is there a 'no cohabitation' clause in the order for spousal support ?

Did she sleep with her foreign friend during his 3 month stay with her ?

"what can be done so she doesn't lose the only income she has left?"

Here is the thing... why are child support and alimony the only income she has left? Mom needs to do what she can to not depend on an abusive ex who has already shown himself financially unreliable. He "was to pay all bills etc but he let the house forclose on them", so even if alimony remains court ordered, actually collecting it is a different story. What is the reason that dad was to pay "all bills etc" and mom was not financially responsible for anything? Regardless, financial dependence on anyone is bad, financial dependence on an abusive ex is worse, and financial dependence on an abusive ex with a history of not making agreed upon payments is pretty irresponsible at best. Mom owes her daughter and herself better than that. So, what can be done so she doesn't lose the only income she has left? Create an alternative income... mom needs to provide for herself and the daughter and put herself in a position where she can provide for both of them with her income alone.
