Kept out of vital decisions/details about my kids
      #790776 - 09/04/12 03:47 PM

During the process of divorcing my emotionally abusive & controlling husband, I realized I needed a lot of emotional support that I didn't have where we lived. So I moved from UT to ID where all my family lived. I was told that since my oldest child had started school in UT, he was considered a resident & that inevitably I had to give physical custody of both my children to my ex. We do have joint legal custody, however, as well as a parenting plan that he & I wrote together.

I have since moved back to UT. The parenting plan states that if I have any major life changes, the visitation portion, etc. would be revisited. Not long after I moved back, I requested that we go back to the 50/50 visitation that we had prior to me moving & he has denied me ANY change at all. So I literally live less than a 10 min. drive from my children & my ex only allows me to see them 1 weekend a month & 30 days in the summer. Additionally, he has consistently refused to communicate with me regarding important decisions & the welfare of our children, despite my multiple emails & texts on the subject. This includes:

- not allowing me access to daycare & school info, or to even be listed as a point of contact (last yr my oldest son was expelled 4 times & I only learned of it from him during summer visitation, not my ex)

- not following the parenting plan that states that I be a part of any medical treatment (my oldest was diagnosed as having either ADD or ADHD - ex won't tell me which one it is - & ex refuses to involve me or fill me in on his treatment or even tell me the name/info of his psychiatrist)

- ex had to take the children out of daycare due to payment issues (I don't know if he was paying - he refused me access to the daycare's invoices, but since March I've been unable to work & therefore was unable to pay my portion). I offered to personally provide preschool for my 4 yr old & after school care for my 8 yr old, since I couldn't pay & my ex said, "That is not an option." Instead, I learned (again, from my kids) that my youngest is being watched by my ex's boss's wife (with no preschool program) & my oldest is in an after-school program at the school & STAYING HOME ALONE if needed - at age 7! My son accidently told me that last one; said Daddy told him not to tell me.

- I also have questions about the quality of their home life & the physical environment my children are being raised in, based on everything they've told me, what I've seen, and my experience with my ex while we were married.

What should I do? The parenting plan says that we have to go through mediation before we go to court... is that what I have to do before I can do anything else? How do I do that, especially with no income? Do I take him to court for contempt? I have been keeping a journal about the last 6 months of concerns, observations, etc. & I have extensive emails/texts backing up a lot of what I'm saying... PLEASE HELP!!

Your os was expelled from 4 different schools ?

File for contempt each time your ex violates the co.

Talk to a lawyer.
