After 23 years and not split up for one day my wife is working on leaving me. She says she needs some time to regain the feelings she had. She says she is empty inside. If I move out do I give up any of my rights? I love her more then my own life but I can't be blind either.

If SHE wants to "find" herself, why would YOU move out?

If you move out, then you set a precedent that will not go in your favor if/when the divorce proceeds.

Yes. My advice is document everything. Every asset, every penny, every hour. If you move out or you start giving her money to live on until you get to court, etc., the more time that passes, the judge will see that as you accepting those terms as "the status quo". An example: If YOU move out then YOU abandoned the household therefore a judge is more likely to award the house to her. I'm not saying this is guaranteed. Every state is different, every judge is different and every circumstance is different, but they will look at whatever agreements you have established (even if only temporary) as acceptable to you and will lean in that direction when passing judgements.

If you have kids you absolutely cannot move out! Even if you don't have kids, moving out will likely give her an upper hand. You'll probably end up paying all of the bills while she lives in and gets to keep the house. Find another room in the house to make "yours" and put a lock on the door. "Move out" to that room.
