Hello..hope everyone has a wonderful new year..thank you for having me on this forum...now, here's my deal..I live in Alabama and my husband's primary residence is in Tennessee..I walked out 7 years ago when I inherited my homeplace here in Alabama..Do I file for divorce here in Alabama or Tennessee?...Do I have any rights to the house in Tn?..Do I have any rights left since I walked away?..We adopted a grandchild in 2003 and my husband is very stingy about this child..I rarely get to see him...please help me with some advice because I plan on moving back to Tenn. asap to be near my children and grandchildren..I want all ties cut before I sell my house and buy another..I want partial custody of this child so I can return him to his mother..that's right..my husband keeps this child with him and barely lets his mother see him..she was 15 when he was born and the father signed him over to us..a legal adoption...thanks in advance..I look forward to a discussion soon..

You can file for divorce in Alabama, he could file for it in Tennessee.
You walked away? I'd strongly hope that you have no right to anything of the Tennessee house as you essentially abandoned it. Your adopted grandchild? Is now 7 years older than it was when you walked out. Have you sought a visitation order? Paid child support? Obtaining partial custody will be difficult, if not impossible, considering your actions. And obtaining partial custody for the sole purpose of returning him to his mother? Good luck with that one.
The child has been adopted -- although a now 22 year old woman gave birth to him, he is no longer her child, he is yours and your husbands.
From the information given here, your actions wouldn't warrant you receiving a lot financially from a divorce. You want to sell your Alabama house and pocket those proceeds **perfectly legal** AND you want rights to the Tennessee house also? Really?
Uphill battle here. Get an attorney.

Sounds like the child's grandfather, your stbx, has been the only one who hasn't abandoned the child. Why would a change in custody be in the CHILD's best interests ?

You inherited the house in Alabama. Perfectly legal and all yours as separate property. If Tennessee is a community property state you do have a legal right to 1/2 the assets in TN. Also legal.
If the child was adopted with only his FATHER signing off on it, that is an ILLEGAL adoption and also contestable. The mother AND father BOTH have to sign the adoption papers. The mother can take that to court no matter how old the child is now.
