Quickie Divorce: How To Get Equitable Settlement
      #800475 - 03/07/13 10:08 PM

I want a quickie divorce from my husband of two years. I also want an equitable division of assets. I would be happy with 50/50.

He has control over our savings accounts, his mine, and ours. I can look at them, but I don't have access to them. He is sort of controlling.

He has had a higher salary than me, and I have had medical costs. I pay my own medical costs without help from him. He has saved money also by habitually not engaging in any activity over the course of the marriage that would require money. I haven't spent money recklessly.

He has a retirement he has started for just him. I haven't had the money. Our common savings account is modest compared to his private savings.

Bottom line: He regards his money as his. There was never any sense of financial partnership in the marriage.

I'm afraid he will resist splitting things equitably, especially when he erroneously blames me for the major problems in the marriage. He's been an alcoholic.

He has a free place to stay after the marriage, indefinitely. I've got rent and bills. He was given a free car. I just had to buy a new used car.

I had $2500 inheritance, but I'm afraid I let it co-mingle in one of the accounts.

We have no property and no children.

Thanks!

I would actually like to make a moral argument with him. What is the moral argument for equitable settlement (the standard for asset division in my state).

If your state considers any money earned during marriage to be joint print everything out ASAP so that if he starts moving things around and hiding them you have a record of where they were on this date.

It may not be up to what he thinks is fair. 50/50 is a common split in most states. of course that means the debt also so be prepared if there are a lot of bills to be jointly responsible.

When we were together, you said you'd die for me. Now, I think it's time you kept your promise.
