Hi all. I am new here. I have a question I'm hoping someone can help me out with. I got divorced @5 years ago. My ex incurred our marital debt in the divorce and promptly filed bankruptcy and abandonment on our marital home. By the time everything was said and done our house was foreclosed and sold at sheriff sale. I struggled with the mortgage company for years to try to resolve things before the sheriff sale to no avail. When the govt began investigating fraudulent foreclosures I filed a complaint. I just found out today that the mortgage company has been made to make payments to some people for their activities. Our house was included in this. So my question is this--since my ex claimed bankruptcy and abandonment on the house is he still entitled to half of the payoff that the mortgage company is sending even though I did all of the work to be eligible for the payment?

Yes he should be entitled to half the payoff from the marital home you shared.

My problem covers multiple issues but here is where i'm going to start. I've been divorced for 2 yrs. We equally still own the 11 acre estate which has been up for sale to be divided 50/50.She is responsible for the mortgage and lives in home.She took me to court last week to force me to sign a Quitclaim deed so she could do a short sale for $9000 less than we owe Which i have won but have found out the mortgage payment has not been made in 8 months and is going into foreclosure any day.The bank told me if i bring payment up to date this week of $12000.00 that would stop foreclosure.My ex and i agreed she would Quitclaim to me and i would pay $12000.00 to save the house.She refused today to sign. Is bankruptcy an option to stop foreclosure. Im out of time Need advice on options
