I put this on the Spousal support board and the stepfamily board but though there might be advice available here...
When calculating child support and spousal support if the individual files for child support through CSE without having filed for spousal support yet due to the other party having paid cs and ss voluntarily until the other party got a significant other and now refuses to pay anything for the children or the spouse - can an order be done for cs and then when a legal separation is filed an order for ss be included or should the receiving cs and ss party file all at once?
This is a good friend of mine and normally I do not agree with ss but this individual is disabled and was married 23 years, became disabled during the marriage, the other parent does not even want parenting time and my disabled friend is capable of caring for the children - they are of school age and the disabled parent has always taken care of the children.
I told my friend that maybe school would be something possible to increase income and become more self-sufficient but I really do not see working full-time or maybe no even part-time in this individuals future - my friend is at a total loss of what to do since the stbx is not following the agreement any longer.
I would like to give my friend some advice on what to start with and how to get it all done as cheaply as possible - I have told my friend to get free consultations with attorney's but we live in a desolate area and would require trips of about three hours rt and that is doable but exhausting on my friend.
Any help is appreciated and please no disrespectful comments that are of no help whatsoever.
