Out of compliance w/custody, now plans to move
      #802108 - 04/13/13 03:57 PM

My ex and I have joint legal and physical custody of our son. I gave her permission to take our son out of school (to be tutored) for two months while he competed in a horse event in Palm Springs. While down there, I discovered she and her BF had sold his home, and the weekend my son was due to come home, she "informed" me that she would be moving to Las Vegas. She also "informed" me that she would be renting an apartment for me, and would fly me out every other weekend. I told her she could move, but our son would stay her and she could fly out every other weekend, to which she replied "Oh, that won't work."

She continues to stay in Palm Springs, with our son, and I have now lawyered up, written a demand letter that she return this week. It appears that her plans to move (I thought just to Palm Springs) have been in place for some time, as her BF's home (where she lives with my son 50/50) was put on the market before she left for Palm Springs.

I am waiting for her to comply with my demand letter, which states she return with my son this week, before I file contempt charges against her. Here's the catch - her BF is a profanely wealthy man, and I'm afraid she will just wear me down financially. Does this say "Bad Faith" to a judge, or what? I only want what's best for my son, we are very close, he's a good kid, and I don't want him in the middle of this (although he already is). My ex is just entitled and extremely manipulative.

He was home a few weekends ago, when his mom was her to oversee the move out of the house, and she recruited a girlfriend to "pitch" the move to Las Vegas to my son - I'm doing my best not to lose my mind - advice??

Have your attorney file to have the child immediately returned to his state and into your custody while a long distance parenting plan is worked out.
