Alimony
      #802750 - 05/09/13 11:21 AM

Could you please advise me on the following. My wife and I are divorcing in New Jersey after 2 years of marriage. No children, no common assets. Does she have the right to claim any alimony? If yes, how is it determined?

I would really appreciate your feedback

Is she working, or capable of working? If yes, then its highly doubtful she'll get any alimony for such a short term marriage.

If not, say because of a disability that prevented her from earning her own living, it would be short term (a few months at best).

She can always ask for it, that doesn't mean she's going to get it.

Hi Javajunkiee,

Thank you for your answer. Yes she is working, you calmed me down quite a bit.

Best

I'm in NJ. With a two year marriage and no small kids, alimony is extremely unlikely. One caveat, if your stbx became disabled during the marriage, then it may be ordered. But even with that, it's not a given.
