Quick Question on custody
      #734 - 07/12/04 09:28 AM

I'm a bit concerned about the possibility of my wife moving out of state with my children. Is that legal in MN without my permission. Also, I'm getting ready to sign my divorce papers, anything obvious I should make sure is or is not in there. We are getting joint legal custody, with my ex getting sole physical

If the papers haven't been signed, then there is nothing to prevent you from addition a stipulation that says she can NOT move any further than 60 miles without your written consent or a court order.

Also, if you have Parenting Time, then your STBX does NOT have "sole physical custody" and I would have that removed.

Right, stipulate that you want the children to not leave the jurisdiction of the state, therefore if your wife wants to leave then the children will have to stay with you. Her choice

This is not necessarily the case universally [Re: Gecko]

I have sole legal and physical custody. My ex has visitation, or Parenting time.

Melody-

How often is your ex's visitation? How did you end up with sole legal and physical? I know states are all different. In my state, hardly anyone gets sole anything. I asked for it because my ex is so bizarre. But my atty changed my request when she sent it into the court and asked for me to have "primary"(without consulting me AND charging me for making the revision). I wish she had left it at what I asked for...since that is what I wanted.

My orders are: [Re: mom]

Mom - My ex sees the kids for 90 minutes every Thursday for dinner and every other Sunday afternoon for 4 hours. He stipulated to sole legal and physical rather than go through the investigation/hearing on the child abuse allegations made by the children. He had no contact for several months under a TRO while the legal mess was developing, then we agreed to supervised therpeutic visitation with a psychologist, but he didn't like that. He quit visits after a little over a month and didn't see them again until we negotiated the current arrangement (about 4 months). It has been in place now for two years.
