ADOPTION SUBSIDY

Hi Everyone,

New to this site, been divorced now 3 years and continually am in court for CS. I have tried on several occassions to get a reduction but have been denied. One question I have, my oldest son was adopted by myself and X and we had received a monthly subsidy from the state and my X continues to receive this subsidy but I do not get any credit for this amount against my weekly CS. Has anyone had experience with this??

If you live in a state where both incomes are figured into the CS calculations, the subsidy should be counted as part of her income...so essentially you do get "credit" for it.

If you live in a state where CS is based only on your income, it doesn't matter what she gets from whom, so you won't get credit for the subsidy, no matter what you do.

That's just sick. That money is supposed to be for the SUPPORT of that child, and if you're paying support, then that's like double dipping and SO WRONG.

I think the purpose of a subsidy is to ease a financial burden, not relieve it entirely. But then again, I've been wrong before.

Thanks, just wanted some input. I understand that it should be counted, but the judge i get to deal with wont hear of it. Whereas I get nitpicked for a 12.00 a month charge I claim as business expense. All the while I am overpaying by 60%! So back to court I have to go. What gets us is that she gets to get this money, which is an extra 6k a year free & clear & I get no credit whatsoever.

If you're in a state that bases CS on both incomes, the subsidy should be counted on her end. If it's not, I'd be unhappy as well.
