My stbx filed for divorce while I was just shy of being 8 months pregnant with our second child. I know Texas law prohibits filing for divorce while the wife is pregnant until 3 months after the birth of the child. To make a long story short, he neglected to tell his lawyer I was pregnant and I was served divorce papers anyway. On to my question. Does anyone know if this voids out the divorce filing and if my situation (being served while pregnant) can be used to my advantage when this all goes to court?? Anything additional would be a great help.

There is no problem serving you while pregnant. The divorce cannot be finalized and child support orders cannot be set until after the birth of the child. His filing has no affect on the outcome.
