I have been on this site for a while, so I will sum up my situation...
Husband walked out on me while I was 6 months pregnant for a woman in his unit. The divorce was put on hold because he was overseas, but he is back now.
On to my question: We are NOT divorced yet and I know the military doesn't recognize separation. I thought he was living in the barracks, but have come to find out that he is renting a house off base with his mistress. He is paying me partial BAH like he is supposed to, but is he allowed to live off base while technically being a single soldier?? Plus, can he still collect BAH for his housing?? I know that is supposed to end once we are divorced, but I thought single soldiers were supposed to live in the barracks. He is an E-5 if that helps.
I am not sure if I got my question out well enough, but any help would be greatly appreciated.

Depends on the base and the branch. I think most people above E-4 in the Air Force are allowed to live off base regardless if they are single or not. The military does not have enough dorms/barracks to house every single person. If he is authorized to live off base, he gets BAH. Maybe his girlfried is paying the bills? Who cares?
Regarding the acknowledgement of legal separation...I guess that would be up to his commander. I was active with a man who was separated from his "wife" for 8 years, lived with another woman and had two kids with her. No one cared, he stayed married to his wife so that she could get health benefits as she had health problems.
