The court order does not say who can file my son. It just says that if there were any problems through the marriage that were not taken care of before signing then each is responsible for it. My question is that I have not said anything about filing my son, but want to know if I tell her that I am filing him next year on my taxes can she do anything about it. Especially since I am certain that her parents are claiming him and not her.

Who is the custodial parent? That is the only one who can claim him. If no custodial parent, then the one he was with more than 50%. If 50/50 (and even if custody is 50/50, there is likely one parent who had the child more) but if truly 50/50 possesion, then whoever Paid more for supporting him. THEN if that's still equal, then the parent with the higher income gets him.
