he owned the house before we married

Hi everyone,
I just suffered the loss of my brother 3 weeks ago and now my husband has had real estate agents come to see how much our house is worth. He wants to see how much he can get for our house and then move out the country, he wants me to go but we have too many problems for me to leave behind the rest of my family and go with him. My question is this: his parents helped him by putting down 100k down on the house about 5 years before I moved in then we married, (for almost 5 years now) he is from Austria and we got married in hawaii. He says, "it is my house, always was and always will be so I can do what I want with it" I have been through 7 years of construction after construction on this house, he just finished the pool and said it was my christmas gift. I have helped him get clients for his business to help pay the mortgage as well as worked on all of his websites he has. Do I have ANY say in the matter of what happens with the money from the sale of house? Do I get anything? I have no education and am 42 years old.
Thank you soooo much for any help, this is just the worst timing but I need to know so I can stop thinking about my future for a minute and mourn the loss of my beloved brother :(.......

Sorry about your brother, this has to be a very rough time for you.

I don't have an answer for you, but I think whatever the answer is will depend on where you are from. I understand in some areas, you may be entitled to half the equity accumulated since the time you were actually married.

If you can post your state, I think you have a better chance of getting a helpful answer.

I got 1/2 the equity from the date we were married until I moved out. $9K

thank you for your reply. My Mother says just be careful honey because once a for sale sign goes up I should file divorce papers right away so that the house is stuck in court and he can't sell it, or he just might run off to belize with everything and leave me stranded with 8 pets...

I wonder how I would go about finding out how much equity has built up, he got it for 250k about 12 years ago and they are saying it's worth 1.2 million or 1.6 and we owe about 300-400k on it. Not sure though, he handles everything as far as finances. This is the worst timing of my life... :(....

You'll have to find out what the market value was for it at the time of marriage. Subtract that from the current price, less the amount owed on the mortgage.

So say hypothetically it was worth 600k at time of marriage, and now it's worth 1.2 million. Take away 400k for mortgage, that leaves 200k marital equity, and 100k each from that portion (plus he'd have all of his equity prior to the marriage. So it would be 700k for him, 100k for your using these amounts.

Thank you for your reply. I just found out we owe 800k on it :( Looks like I need an attorney so I can impede the sale of the house? I have zero money to pay them but there are assets so I should be able to find one, right? He wants to sell our house and move into a rental for a few years then move to belize. I told him so many times I don't want to move away from my family and friends but he just keeps planning without me. And he is sooooooo vengeful, once he learns I have put a lien? on the house he will cut all my communication to the outside world, cell phone, computer and tv, I know it... :(......and maybe even worse, I'm so afraid to do this but my friends keep telling I have to protect myself... :(
