She wants to move kids out of town

Hi - i got just divorced, she has primary physical custody and i have visitations every weekend and every wednesday, we lived in Tucson, AZ and we always live here, she wants to move to Nogales AZ which is about 65 miles south from Tucson and buy a house and get a job there. Can she really move out of town and go to another city?? can i stop her from doing that?

You want to work on your wording before you go any further..

It is her constitutional right to move anywhere she wants..
However, there are sometimes provisions where you get to object to your children moving away...

The Gecko knows the AZ laws so I would wait until she weighs in w/ the facts.. Or you could pm her..

I know the first question that she will ask: "Is there any verberage in your CO, refraining her from moving? AND if so what does it say exactly?"

Other info that would help is:
Why is she moving?
Does she have family there?
Does she or you have family where you are now?
How old are the children?

she just want to move because she wants to go back home thats all with her parents and family. we both have family her in Tucson also and we being here together for 12 years already, our kids born here in Tucson also, they are 5 and 8 yrs old. Her family is telling her to go back home (Nogales) thats why she is wants to move.

Unless there is a contrary stipulated agreement in your court order , your ex does not need your or a courts permission to move in-state less than 100 miles away .

I am not sure about specific statements in your CO but I don't think she needs your permission to move seeing as it's still in the same state.. and only like an hour away.. that's not a huge deal..
