I just moved (I left my husband) to AZ from CA on Fri 13th of last month. I spoke with someone here and they told me I cant do anything until I am a 'legal residence' 90 days. I just starded my job last monday here in Phoenix. Does that make me a legal residence? If not am I tecnically a resident of CA still? I really want to get my divorce done and over with as fast as I can! What do I need to do to become a residence? Or should I just take a day off work, drive to Ca and do the paperwork there, so that I dont have to wait 90 days just to start and then who knows how long after that!! I really dont want anything else to do with this man. We have no kids and we are not fighting over anything. The only thing we need to fix is that his truck he is driving is in both our names and the suv im driving is in his name, so we would somehow need to get that fixed (but I dont know if thats possible). Does anyone know the quickest, simplest, pain-free way of knoccking this out??
Please help me anyone =(

HE can file in CA, you can't. You may TECHNICALLY still be considered a resident of CA if you haven't changed your address with the DMV, etc., but he could contest it if you try to file in CA, if he wants to cause trouble. If he doesn't, just have HIM do the filing. The quickest and simplest would be for him to pick up a no contest packet from the courthouse. No contests generally run a couple hundred, depending on what each state charges. CA's an expensive area, it may even run $500, but they're still the cheapest. He can complete the paperwork, send it to you to look over and sign, then you send it back to him to sign and file. You may need to be in court briefly in CA, and you could likely request to hold the hearing via telephone, so you don't have to travel there.

You only become a legal resident of a state when you meet their residency requirements, which is a certain length of time. Apparently, AZ requires 90 days. Most states require 6 months to a year.
