How do you prove cohabitation?

If a woman who is receiving alimony is not staying at the home that she received in the divorce, but instead is staying with her very wealthy boyfriend, is that cohabitation? She appears to still receive mail there and it doesn't appear that she's renting it out, but the neighbors say that she hardly ever spends the night there. How long would you have to have a private detective watch her to prove cohabitation? This woman has no problem with lying to the court. She lied about several things during the divorce testimony, so I'm sure that just asking her won't work.

As long as she maintains a separate residence...that is NOT being rented out...there is nothing you can do.

You can't because she's NOT cohabitating. She's maintaining a seperate residence for herself. Cohabitating "implies" living together, sharing bills, such that you are no longer entitled to the support of your former husband.

What she's going does not meet that criteria.

You don't lose a court-ordered divorce settlement simply because you've moved on with your life and are having sleep-overs with your boyfriend.

Is is cohabitating. She is just maintaining the other place to defraud the courts and the OP.

Thertefore she is a criminal cohabitator.

---> Legally...borderline. The problem with trying to pursue something like this is that she can simply go back to living in her home 4 out of 7 night.

---> Now if this is the same poster as last time...then he might have more cause of action considering the boyfriend lives in another state. But the main problem is that so long as she maintains her residence AND the boyfriend does not "live" there and/or it doesn't become a "vacation" residence for the BOTH of them...the courts aren't going to do anything.

---> And one last thing...regardless of your PERSONAL opinion, you have to remember that people are coming here for "legal" advise. Example...it is my personal opinion that she is "co-habitating" but "legally"...she is not, so I'm not going to tell a poster that she isn't and then have them go to court with the expectation of winning and instead, they get their asses kicked. See where I am coming from?
