I live in Florida and separated from my husband. We both have interest in our house that me and my kids are living in. He is 100% vested in his pension and I have been married to him since he started the job.
How does the pension settlement work?? I think I'm entitled to 1/2 his pension for the 11 years. I'm only 38 years old, do I have to wait until he retires?? or can I get him to sign the house over to me in lieu of 1/2 the pension?

You could in fact do that... if he bites. Depending on how much retirement you would get vs. the equity the house. I'd def. speak to an attorney because I know that FL has some weird laws on retirement, I believe that is why OJ Simpson moved to FL, because FL could not touch his NFL retirement funds. If you have any kind of pension is it also subject to division.
